These Terms & Conditions govern the relationship between you (“Client”) and Simona Rakauskaite (“Service Provider” or “I/Me”) regarding wedding content creation services. By engaging my services or using my website, you agree to these terms.

1. Scope of Services

I provide wedding content creation services, including but not limited to:

• Photography and videography for weddings and related events.

• Social media content creation (Instagram, TikTok, Reels, etc.).

• Editing and post-production of photos and videos.

Services may also involve collaboration with trusted third-party providers.

2. Contract Formation

• Quotes and proposals are non-binding unless explicitly stated.

• A contract is formed when you sign a written agreement or accept a quote (email or other written form).

• I reserve the right to refuse services at my discretion.

3. Execution & Delivery

• I will provide services according to the agreed schedule. Exact timelines may vary due to unforeseen circumstances.

• Work begins only after confirmation of the booking and all required information is received.

• Delays caused by third parties or force majeure (e.g., technical issues, weather, illness) may extend deadlines.

4. Third-Party Providers

I may engage third-party providers (e.g., assistants, editors) to fulfill services. I remain responsible for their work and adherence to confidentiality and privacy standards.

5. Fees & Payment

• Fees are specified in the agreement or quote.

• Additional expenses (travel, accommodations, props, or other costs) may be invoiced separately.

• Payment terms: invoices are due within 7 days of issuance, unless otherwise agreed. Late payments may incur interest and collection costs.

• I may request partial or full prepayment before services commence.

6. Client Obligations

You agree to:

• Provide accurate and timely information required to deliver services.

• Review and approve delivered content promptly.

• Pay invoices on time.

7. Cancellation & Refunds

• Cancellation must be communicated in writing.

• The booking deposit is non-refundable in all circumstances.

• In the event of cancellation, the following applies to any additional amounts paid beyond the deposit:

  • Cancellation more than 4 months before the event: 50% of total agreed fees is retained by the Content Creator.

  • Cancellation between 4 months and 2 months before the event: 75% of total agreed fees is retained.

  • Cancellation within 2 months of the event: 100% shall be retained by the Content Creator.

8. Intellectual Property

• I retain all rights to content I create (photos, videos, edits).

• You receive a non-exclusive, non-transferable license for personal use or agreed purposes.

• Public use of content for commercial purposes requires written consent.

9. Privacy & Data Protection

• I handle personal information in accordance with my Privacy Policy.

• Client data (emails, photos, wedding details) will not be shared with third parties except as required to provide services or comply with legal obligations.

10. Confidentiality

• All information shared by the client or obtained during the project is treated as confidential.

• Confidentiality obligations survive the termination of services.

11. Limitation of Liability

• I am not liable for indirect, incidental, or consequential damages arising from services.

• This includes but is not limited to: technical failures, loss of data, missed deadlines due to circumstances beyond my control, or misuse of delivered content by the client.

12. Governing Law

• These Terms & Conditions are governed by Swiss law.

• Any disputes will be resolved at the court of jurisdiction in Thun, Switzerland.

13. Amendments

I reserve the right to update these Terms & Conditions at any time. The most current version will always be available on my website.
